EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF TITLE AND/OR NON-INFRINGEMENT IN RESPECT OF THE EXHIBITWARE.COM WEB SITE.
2.3 Exhibitware and all of its suppliers, content providers, affiliates, licensors, employees, agents and the like, in
each instance will not be liable for
any direct, indirect, incidental, consequential and/or special damages arising out of your use of, or inability to use,
the exhibitware.com web site, and you hereby waive any claims with respect thereto, whether based on contractual, tort or other grounds, even
if Exhibitware has been advised of the possibility of such damages, and/or
damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or
transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration
of, or use of any file, in each instance whether for breach of contract, tortuous behavior, negligence, or under any
other cause of action. For further clarity, in all events, Exhibitware and all of its suppliers, content providers, affiliates,
licensors, employees, agents and the like shall not be liable for the defamatory, offensive, or illegal conduct of
other users of the Internet (including the exhibitware.com web site).
2.4 Some jurisdictions do not allow implied warranties to be excluded or modified or liability to be limited, so not all
of the above limitations may apply to you.
2.5 The provisions of this Section 2 represent a reasonable allocation of the risks under this Agreement.
Exhibitware's willingness to allow you to use the exhibitware.com web site reflects this allocation of risk and the limitations of liability
specified herein.
3. Control of Account. Exhibitware shall have the right, but not the obligation, to, among other things,
(a) monitor conferences and chats and authorize restrictions on access thereto, and
(b) withdraw, suspend or discontinue any functionality or feature of the exhibitware.com web site.
Furthermore, Exhibitware reserves the right, with or without notice to you, to change any of the services offered on the exhibitware.com web site
including, but not limited to, hours of operation, menu structures, access procedures, software commands,
documentation, vendors and/or other services. Any rights not expressly granted in this Agreement are
hereby reserved by Exhibitware.
4. Acceptable Use Protocol. Without limiting any of its other rights or remedies contained herein or at law, Exhibitware
may terminate your account (and, thereby, your access to the exhibitware.com web site) for breaching or otherwise violating any
provision of this Agreement including, without limitation, the breach or violation of any one or more of the following
provisions which constitute Exhibitware's "Acceptable Use Protocol."
4.1 The exhibitware.com web site will only be used for lawful purposes. Use of the exhibitware.com web site for
the transmission or storage of any information, data or material in violation of any federal or state regulation or law (including,
but not limited to, material protected by copyright or trade secrets, and information that is confidential as a matter of law) is
strictly prohibited. Without limiting the generality of the foregoing, you agree not to:
- Use the exhibitware.com web site, under any circumstances, to:
(a) publish, post, distribute or disseminate defamatory, infringing, obscene or unlawful material or information,
(b) threaten, harass, stalk, abuse, or otherwise violate the legal rights (including rights of privacy and publicity) of others,

(d) send "spam" e-mail messages,

- Send e-mail for any purpose other than personal communication including, without limitation, to advertise or offer to sell goods or services to others (except as otherwise expressly permitted by Exhibitware),
- Download a file that you know (or reasonably should know) cannot be legally downloaded (a file may have
been uploaded notwithstanding such illegality), and/or
- Act, or fail to act, in your use of the exhibitware.com web site, in a manner that is contrary to applicable law or regulation.
The failure to observe any of the foregoing may result in civil or criminal liability, as well as termination of your
account.
4.2 Use of the exhibitware.com web site for advertising or promotion of a commercial product or service (other than in areas of the
exhibitware.com web site that Exhibitware specifically designates for such purposes, if any) without the express, written consent of
Exhibitware is prohibited.
4.3 The transmission of chain letters, the conduct or promotion of gaming or lotteries, and the conduct or
promotion of any illegal activity via the exhibitware.com web site is strictly forbidden.
4.4 There may be news groups, electronic mailing lists, bulletin boards, chat rooms, and/or other message or
communication facilities on the exhibitware.com web site which focus on a particular topic or set of topics. You shall use any
news groups, electronic mailing lists, bulletin boards, chat rooms, and/or other message or communication facilities
only to send and receive messages and materials that are proper and related to the particular news group, electronic mailing list,
bulletin board, chat room, and/or other message or communication facility.
4.5 You shall not engage in any conduct that intends to disrupt the normal flow of dialogue within chat rooms.
4.6 Files that are uploaded and your activity in conferences and chats are subject to review, modification
and deletion without notice. Files uploaded may be subject to posted limitations on usage, reproduction
and/or dissemination,and you are responsible for adhering to such limitations if you download them.
